EM13c : Upgrading The Windows Agent Failed - emctl_upgrade.bat does not exist (Doc ID 2598140.1)

In Enterprise Manager (EM) Cloud Control, While upgrading the agent on Windows fails with "emctl_upgrade.bat does not exist"

Following stack observed from <Agent_Home>/cfgtoollogs/agentDeploy/agentDeploy_<timestamp>.log:

INFO: Executing command: <Agent_Home>\oracle_common\jdk\jre\bin\java -jar <Agent_Home>\jlib\updateStateDirectory.jar -emStateDir <Agent_Inst> -oldAgentHome <OLD_Agent_Home> -newAgentHome <Agent_Home>
INFO: Failed to modify state directory <Agent_Inst>
INFO: <Agent_Inst>\bin\emctl.bat (The process cannot access the file because it is being used by another process)
INFO: at Method)
INFO: at<init>(
INFO: at oracle.sysman.gcagent.common.FileUtils$SyncingFileOutputStream.<init>(
WARNING: The emctl file in instancehome <Agent_Inst>\bin\emctl_upgrade.bat does not exist
INFO: Access is denied.
INFO: cmd /c <Agent_Inst>\bin\emctl.bat start agent completed with status=1
ERROR: Agent Deployment Failed
