The following is observed on Windows Server 2008.

tmshutdown -k KILL -i (id) does not stop the server process on Windows 2008.

When -k TERM (SIGTERM ) is issued, then also it is not stopped.  The following error is logged in the ULOG:

092024.TuxMachineName! 01-22-2010: Tuxedo Version with VS2005, 32-bit
092024.TuxMachineName! CMDTUX_CAT:4475: INFO: SRVID = 705 SRVGRP = A_FTLA SIGTERM send failed (tperrno = 7)

This works well on Windows 2003 and Windows XP.

Changed to Windows 2008.
