When Using Framework Folders Content Items Become Orphaned when Deleting a Folder Which Contains Content that is not Owned by the Folder Owner

Symptoms
WCC 11.1.1.6 patchset MLR10 (Jan 2012) or earlier.
Framework folders component.
Deletion issue for content in a folder not owned by the folder owner :
- User1 logs in and create a folder
- User2 contribute a content item to the folder
- User1 deletes the folder
- System give the following error: "Unable to delete items. You do not have permission for 'delete' operation on '' folder". This error is produced for the content item which User1 checked-in.
At this point the folder is deleted and the content item is not added to the Expired Content List. This document can also be searched for and its state is also set to "Released".
The above content item from this point is searchable but unusable. When any user (even system administrator) try to update this content item you get the following error:
