ASCP ECC Constrained Plan Not Honoring Resource Capacity Constraints When Using A Source BOM/Resource Capacity Simulation Set

Symptoms
On : 12.1.3 version, Constrained planning
Users are on 12.1.3 and have applied VCP 12.1.3.8 Patch 14247039 - Using 64 bit AIX MBP MSONWA64.ppc 120.16.12010000.73 - running ECC Classic Constrained plan With Resource Constraints = Yes and Supplier Capacity Constraints = Yes - They have a Bottleneck Resource Group = CONSTRAINED. It should be noted that users have plan option Overwrite = Outside planning time fence. When a simulation set is associated to the plan options organization tab and capacity is added or subtracted across time the plan no longer honors capacity constraints and allows capacity load ratios to exceed 1.0. (ie 100%) - In other words, resources are overloaded

Simulation Set attached to org in plan options = JM_CAP
They have Simulation Sets for resource attached at the Org level in the plan options (It's created in the source instance and collected via data collections). When they run ASCP WITH the Simulation Set they see resource overloads across the board for almost all Bottleneck resources. When they remove the simulation set, the resources don't get overloaded. They only have planned orders in the plan itself, they don't have any wip or PR/PO supplies in the plan
In the horizontal plan for 28-APR-2014, 29-APR-2014 and 30-APR-2014 - they show the same resource overloaded amounts
Available Hours = 21.2
Required Hours = 27
Capacity = 130%
This continues into May and further out

Expect no overloaded resources in ECC Constrained Plan
STEPS
-----------------------
The issue can be reproduced at will with the following steps:
1. Run ECC Constrained Plan
2. Make changes to resources in in source EBS and save in Sim set and collect it
3. Attach simulation set to ASCP plan In Org tab and run it
4. See resources are overloaded (ie over 100%)
5. Remove the Simulation Set and run the plan and no overloaded resources
