Incorrect target for symbolic links causes OUI-67022 / OUI-67073 when applying patch 9046133

IBM z/OS on System z
(Note: This can occur in any patch being applied on z/OS (USS))
Initially, version of Java being used is 1.5.
After installing Java 1.4.2 (as per Note 836717.1) and verifying with :
$ java -version
java version "1.4.2"
Java(TM) 2 Runtime Environment, Standard Edition (build 1.4.2)
Classic VM (build 1.4.2, J2RE 1.4.2 IBM z/OS Persistent Reusable VM build cm142i
fx-20070813 (SR9a) (JIT enabled: jitc))
the opatch apply (for patch 9046133) still gets the following error messages and aborts:
FINEST:PatchObject::loadActionFile() returns exception
SEVERE:OUI-67022:Interim Patch metadata parsing failure... 'Unable to parse the xml file.'
SEVERE:OUI-67073:ApplySession failed: ApplySession failed in system modification phase... 'Unable to create patchObject'
INFO:Stack Description: java.lang.Error: ApplySession failed in system modification phase... 'Unable to create patchObject'
Opatch version is : 10.2.0.4.9 (for platform IBM z/OS)
JAVA_HOME, PATH, LIBPATH, CLASSPATH also include the new Java 1.4.2 directory
