Purpose

 The objective of this note is to assist customers of EBS to understand the implications of the Legislative Update: Federal Senate Resolution 13, 2012 Agreement ICMS 38, 2013.

Scope

 Federal Senate Resolution 13, 2012 Agreement ICMS 38, 2013:

Brazilian states used to offer special benefits and incentives with respect to ICMS (Tax on Circulation of Goods and Services). Many of these state incentive programs have been controversial and they have created a so-called fiscal war between Brazilian states as they battle for a competitive advantage over other states in attracting investment to their territories.

On 26 April 2012, the Brazilian Senate put a partial end to the fiscal war by publishing Federal Senate Resolution no. 13.

Such Resolution 13/2012 reduced the tax rate of ICMS to 4% on interstate transactions with imported goods and merchandises or products with high import content. On May 23, 2013 the Agreement ICMS 38/2013 was published, providing new procedures to be followed in the application of the ICMS tax defined in the Federal Senate Resolution No. 13.
