Why does list of values for Applicable Tax only contain "Not Applicable" when creating a tax applicability rule?

Symptoms
Creating a tax applicability rule.
When you get to step 3 you have the "Applicable Tax" box with a list of values.
Click on lov it only has one choice of "Not Applicable".
Why is only "Not Applicable " available and not "Applicable" available?
