Legislation makes it mandatory to track painful situations to which employees are exposed in their workplace, in order to better prevent occupational diseases, starting January 1st 2015.
The prevention factsheet supports the Occupational Painfulness Prevention Entitlement (CPPP - Compte Personnel de Prévention de la Pénibilité), which is effective 1 January 2015. In fact, the exposure of an employee to one or more risk factors triggers the obligation to establish right to acquire points on an employee’s account (Labour., Art. L. 4162-2). However, as of January 1, 2015, the employer should note in the prevention factsheet the conditions of drudgery resulting from the exposure of each worker, beyond certain thresholds, to one or more associated factors of occupational hazards
The law has defined ten specific risks that will be tracked going forward, but only four of them will be tracked as of January 1st, 2015, these are;
1. Night work
2. Work in alternating succession of shifts (eg 3x8 or 24x48)
3. Repetitive work
4. Hyperbaric activities
6 other factors that will apply from 1 January 2016;
1. Manual handling of loads
2. Painful postures
3. Mechanical vibration
4. Hazardous chemicals
5. Extreme temperatures
Oracle PeopleSoft’s patch details:
Oracle will deliver an update in PeopleSoft Global Payroll for France product to manage these new contributions:
• The general contribution that will apply to all employees, effective January 1st 2017 (since government decided not to apply it on calendar years 2015 and 2016).
• The specific contribution that will apply only to employees exposed to the specific risks that are being tracked (i.e., 4 risks in 2015, more in the following years), effective January 1st 2015.
However, it will be up to each customer to identify and track employees who are exposed to those risks and to do appropriate payroll setup to trigger this specific contribution.
Oracle doesn’t plan to deliver any update in the Health & Safety module from PeopleSoft HR Core to accommodate potential impacts of the legislation in this module.
