It came to our attention that our system is not following the guidelines for NJ garnishments. There should not be a deduction for employee’s that earn less than 30 times the FMW ($217.50), but it’s not taking that into consideration. When the disposable earnings have been less than $217.50, it’s still taking 10% of gross pay for the garnishment.
The delivered rules for NJ do not have any of the calculation formulas setup to take the Federal Minimum Wage into account. Should there be a delivered rule for NJ that contains the formula to use 30 times the FMV for the exemption calculation?
