UK Legislation - Average Weekly Earnings for Statutory Absence during Furlough (Doc ID 2670350.1)

Goal

 The Government has announced that pay for employees taking family related leave (Maternity, Paternity, Adoption, Shared Parental and Parental Bereavement) is to be based on their normal earnings rather than any furlough pay:

Where an employee is receiving reduced pay because they are furloughed for any part of the Relevant Period used to calculate Average Weekly Earnings (AWE), the entitlement must be calculated based on the normal earnings which would have been paid if the employee were not furloughed.  The HMRC guidance on calculating this has been updated on gov.uk

This may impact an employee’s eligibility (if reduced earnings are below the Lower Earnings Threshold), or the amount of Enhanced Statutory Maternity Pay (SMP)  / Statutory Adoption Pay (SAP) due.
